Who we are

This Privacy Policy applies to ban-air.com (the "Site"), operated by BANAIR Group. Depending on which BANAIR Group company you deal with, the controller of your personal data is:

  • Elements Industrial Storage Ltd ("BANAIR UK") — registered in England and Wales under company number 10061252, registered office Unit F, Crackley Way, Dudley DY2 0UW, United Kingdom — for UK operations; and/or
  • BANAIR Inc. Sp. z o.o. ("BANAIR PL") — registered in Poland under KRS 0000820834 (NIP 7393935693), registered office Słupy 42, 10-381 Słupy, Poland — for EU and Polish operations.

Where BANAIR UK and BANAIR PL jointly determine why and how your personal data is processed, they act as joint controllers. You can contact either at contact@ban-air.com, or by post at the address above.

What personal data we collect

  • Identification and contact data when you submit an inquiry — name, work email, phone, organization, country, job title.
  • Procurement-context data when you submit a project, RFQ or partnership inquiry — project description, location, end user, equipment type, quantities, target dates.
  • Marketing-consent data when you subscribe to BANAIR Group updates or download a gated resource — email, country, marketing preferences, consent record.
  • Technical data when you visit the Site — IP address, device and browser type, referrer, pages viewed, approximate location derived from IP. See the Cookie Policy for detail.
  • Correspondence — the content of emails, contact forms and meeting requests you send to us.

We do not knowingly collect special category data through the Site and ask that you do not submit it via web forms. Where special category data is necessary (e.g. health or accessibility needs for a site visit), we will collect it directly and tell you why.

Why we process your data and the legal basis

For each purpose below, the legal basis under UK GDPR and EU GDPR is shown.

  • Respond to product, project, procurement or partnership inquiries; pre-contract due diligence — Article 6(1)(b) contract / 6(1)(f) legitimate interest in conducting our business.
  • Send marketing communications about BANAIR Group products, events and resources — Article 6(1)(a) consent (you can withdraw at any time).
  • Maintain site security, prevent abuse, and operate the Site — Article 6(1)(f) legitimate interest in a secure, available service.
  • Comply with regulatory obligations (export control, sanctions, accounting, defense procurement, and Polish statutory record-keeping) — Article 6(1)(c) legal obligation.
  • Establish, exercise or defend legal claims — Article 6(1)(f) legitimate interest.

How long we retain your data

  • Inbound inquiries not converted to an opportunity — 24 months from last contact, then deleted or anonymized.
  • Customer, partner or supplier contact records linked to a contract — for the life of the relationship plus 7 years (UK statutory limitation and accounting); records held by BANAIR PL are additionally retained under Polish accounting and archival-law retention periods.
  • Marketing subscribers — until you unsubscribe; a suppression record is retained indefinitely so we don't re-contact you.
  • Server and security logs — up to 12 months.
  • Export-control and sanctions screening records — minimum 5 years from the transaction date (in line with UK / EU / US export-control recordkeeping).

Who we share your data with

  • BANAIR Group entities in the UK, Poland (EU) and, where applicable, our US partner network — for inquiry routing, project delivery and group reporting. Internal transfers are governed by our intra-group data sharing arrangements.
  • Service providers acting as processors under written data processing agreements — hosting and CDN (Amazon Web Services and Cloudflare), email and CRM, web analytics, helpdesk, and cookie consent management.
  • Professional advisers — auditors, lawyers and insurers, where necessary to advise us.
  • Regulators, law-enforcement and courts — where required by law, including the UK ECJU and HMRC, the Polish Personal Data Protection Office (UODO) and the Polish tax authorities, other EU competent authorities, and US BIS / DDTC / OFAC.
  • Prospective acquirers in the context of a corporate transaction, under appropriate confidentiality protections.

We do not sell personal data, and we do not share personal data for cross-context behavioural advertising.

International transfers

Personal data may be transferred between BANAIR Group entities and processors in the United Kingdom, the European Economic Area, and the United States. Our hosting and content-delivery providers (Amazon Web Services and Cloudflare) are headquartered in the United States. Where data leaves the UK or EEA to a country not covered by an adequacy decision, we rely on the appropriate safeguards under UK GDPR and EU GDPR:

  • UK transfers — the UK International Data Transfer Agreement (IDTA), or the EU Standard Contractual Clauses with the UK Addendum;
  • EU transfers — the EU Standard Contractual Clauses (2021/914);
  • US transfers — reliance on the EU–US Data Privacy Framework and the UK Extension where the recipient is self-certified, otherwise SCCs / IDTA plus supplementary measures following a transfer risk assessment.

Your rights

Subject to applicable law, you have the right to:

  • access the personal data we hold about you and obtain a copy;
  • request correction of inaccurate or incomplete data;
  • request erasure where there is no overriding legal basis to keep it;
  • restrict or object to processing based on legitimate interests;
  • data portability for data you provided to us and that we process by automated means;
  • withdraw consent at any time for processing based on consent (e.g. marketing).

California residents (CCPA / CPRA): in addition to the rights above, you have the right to know the categories and specific pieces of personal information collected, the right to delete, the right to correct, the right to opt out of any "sale" or "sharing" (we do neither), and the right to non-discrimination for exercising your rights.

To exercise any right, email contact@ban-air.com. We will respond within one month (UK / EU) or 45 days (California). We may need to verify your identity before acting on a request.

Complaints

You can complain to the UK Information Commissioner's Office at ico.org.uk, to the data protection authority in your EU Member State, or (for California residents) to the California Privacy Protection Agency. We'd appreciate the chance to address your concern first — please contact us before escalating.

Changes to this policy

We will post material changes on this page and update the "Last updated" date. Changes that affect marketing communications will trigger a fresh consent request.

Use of the Site

You may use the Site for lawful purposes connected to evaluating, procuring, partnering on or learning about BANAIR Group products and services. You agree not to:

  • use the Site in any way that breaches applicable law or regulation, including export control, sanctions and anti-bribery law;
  • scrape, harvest, mirror or systematically extract content other than as permitted by our robots directives;
  • attempt to gain unauthorized access to the Site, the servers on which it is stored, or any connected system;
  • introduce malicious code, conduct vulnerability scans without prior written consent, or interfere with availability of the Site;
  • impersonate any person, including BANAIR Group personnel.

Intellectual property

The Site, and all text, images, drawings, videos, 3D models, configurators, technical drawings, downloadable resources and software made available through it, are owned by or licensed to BANAIR (Holdings) Ltd and are protected by copyright, database, trademark, design and other intellectual property rights.

You may view, download for caching purposes only, and print pages from the Site for your own personal or internal business use, provided that you do not modify any content and you keep all copyright and proprietary notices intact. You may not republish, redistribute or commercially exploit any content without our prior written permission.

Trademarks

BANAIR®, IARS™, DMTSS™, MUDR™, MOTC™, Rackbox®, LADX™ and NozzleBot™ are trademarks of BANAIR (Holdings) Ltd. Other product names referenced on the Site — including FLEXIPOD, used here under partnership — are the property of their respective owners and are used for identification only. Their use does not imply endorsement.

User content

If you submit content to us through the Site (for example via contact forms, RFQ submissions, partner enquiries, configurator outputs or job applications), you confirm that you have the right to do so and that the content does not infringe any third-party rights or contain material that is unlawful or confidential to a third party without their consent. Such submissions are handled under the Privacy Policy.

Third-party content and links

The Site may link to or embed content from third parties, including links to partner sites. We are not responsible for the content or availability of third-party sites that are not operated by us.

Disclaimers

Information on the Site — including technical specifications, dimensions, weights, capacities, lead times, certifications and capability summaries — is provided in good faith and for general information. Product designs evolve; project-specific specifications, performance commitments, certifications and pricing are set out in the contract and supersede anything stated on the Site. Nothing on the Site constitutes an offer capable of acceptance.

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all conditions, warranties and other terms that might otherwise be implied by statute, common law or the law of equity.

Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

Subject to that, we will not be liable for any loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of opportunity, goodwill or reputation, or any indirect or consequential loss, arising out of or in connection with your use of the Site.

We may update the Site and these Terms from time to time. The current version is the one published on this page; the "Last updated" date shows when it last changed.

Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by English law. The courts of England and Wales have exclusive jurisdiction, except that we may bring proceedings in the courts of the country in which you are based to enforce our intellectual property rights.

We keep our stack small. The tools listed below cover everything we use on ban-air.com.

Strictly necessary — always on

  • Cookie consent record — stores your choice from the cookie banner so we don't ask on every page. First-party. Up to 12 months.
  • Contact form session token — set when you submit the contact form, to validate the submission and limit abuse. First-party. Cleared at the end of the session.
  • Cloudflare bot management — __cf_bm, set by our CDN to distinguish humans from bots and protect the Site. First-party. Around 30 minutes.

Analytics — only with your consent

  • Google Analytics (GA4) — measures aggregate visits, traffic sources and which pages are read, so we can improve the Site. Provider: Google Ireland Ltd / Google LLC. Cookies include _ga and _ga_<container-id>. Retention up to 14 months. Google Privacy Policy.
  • Microsoft Clarity — heatmaps and session recordings on a sample of visits, used to spot usability issues. Form field contents are masked. Provider: Microsoft Ireland Operations Ltd. Cookies include _clck, _clsk, MUID, ANONCHK. Retention up to 1 year. Microsoft Privacy Statement.
  • Ahrefs Web Analytics — privacy-friendly traffic measurement used to monitor site performance and search indexing. Cookieless — uses anonymous request data only. Provider: Ahrefs Pte Ltd. Ahrefs Privacy Policy.

Third-country processing

Google Analytics and Microsoft Clarity may transfer data to the United States; both providers are self-certified under the EU–US Data Privacy Framework (and the UK Extension). Ahrefs is based in Singapore; transfers are covered by the EU Standard Contractual Clauses together with the UK Addendum to the IDTA.

Managing cookies in your browser

Most browsers let you block or delete cookies in their settings. Blocking strictly necessary cookies will prevent parts of the Site from working. The browser vendor websites have step-by-step instructions for Chrome, Edge, Firefox and Safari.

Changes

We may update this Cookie Policy when we add or remove tools or when guidance changes. Material changes will prompt a fresh consent request via the cookie banner.

Our approach

We want ban-air.com to be easy to use for as many people as possible. We design pages with clear typography, sensible colour contrast, keyboard-operable navigation and labelled form fields, and we will fix accessibility issues as they are reported.

We don't currently claim formal conformance with a specific accessibility standard. Where you need information in an alternative format (large print, audio, plain text), we will provide it on request.

Enforcement

In the United Kingdom, the Equality and Human Rights Commission (EHRC) is responsible for enforcing the Equality Act 2010. If you live in the EU, you can contact the equivalent body in your Member State. If you live in the United States, the Department of Justice enforces Title III of the ADA as it applies to commercial websites.

Export control and trade compliance

Overview

BANAIR Group designs and manufactures equipment supplied to defense, government and response organizations, including in the United Kingdom, the European Union and the United States. Some BANAIR products, and the related technical data, software, services and support, are subject to export control and sanctions regulations, including:

  • United Kingdom — the Export Control Order 2008 (and successor regulations), administered by the Export Control Joint Unit (ECJU);
  • European Union — the EU Dual-Use Regulation (Regulation (EU) 2021/821) and Member State controls on military items;
  • United States — the Export Administration Regulations (EAR), administered by the Bureau of Industry and Security (BIS), and the International Traffic in Arms Regulations (ITAR), administered by the Directorate of Defense Trade Controls (DDTC);
  • Sanctions and end-use restrictions administered by HM Treasury's Office of Financial Sanctions Implementation (OFSI), the EU competent authorities, and the US Office of Foreign Assets Control (OFAC).

Compliance programme

BANAIR (Holdings) Ltd operates a trade-compliance programme covering, at a minimum:

  • product, technology and software classification (ECCNs, USML categories and UK Strategic Export Control list entries) before first shipment of a new product;
  • end-user and end-use due diligence at quote stage and at shipment;
  • denied-party, sanctions and politically-exposed-person screening of customers, partners, intermediaries and consignees;
  • licence determination and application where required, including OGEL / SIEL and ITAR licences as applicable;
  • controls on the release of controlled technical data, including to non-UK / non-EU / non-US persons ("deemed exports");
  • recordkeeping for at least five years from the transaction date;
  • training for relevant staff and an internal escalation route for red flags.

Inquiries from sanctioned or restricted destinations

BANAIR Group does not solicit business from, and will not respond to, inquiries that — on the face of available information — would breach UK, EU or US export control obligations or sanctions, including comprehensive sanctions programmes. Inquiries from sensitive end users, dual-use end uses or restricted destinations may be declined or subject to additional due diligence and licence assessment.

Classification on request

Export-control classifications (ECCNs, USML categories, UK Strategic Export Control list entries) for specific BANAIR products and configurations are available on request to qualified procurement teams under a written non-disclosure agreement.

Anti-bribery, anti-corruption and anti-boycott

BANAIR operates in line with the UK Bribery Act 2010, the US Foreign Corrupt Practices Act, and the US anti-boycott provisions of the EAR (Part 760). We do not pay or accept facilitation payments and we will not participate in unsanctioned boycotts.

Reporting a concern

If you believe a BANAIR product, technical data, service or transaction may have been diverted, mis-used or handled in breach of these regulations, please contact contact@ban-air.com. Concerns can also be raised anonymously via our whistleblowing channel.
