ban-air.com is operated by BANAIR Group. Depending on the BANAIR Group company you deal with, the controller of your personal data is either our Polish company, Banair Inc. Sp. z o.o., or our UK company, Elements Industrial Storage Ltd. The Privacy Policy below is in two parts — Poland and United Kingdom — and a single Cookie Policy applies to the whole site. Where both companies jointly determine why and how your personal data is processed, they act as joint controllers. You can contact either at doh87vc@ban-air.com.

Who we are

This part applies where Banair Inc. Sp. z o.o. is the controller of personal data collected through ban-air.com (the "Site"), in particular for BANAIR Group's EU and Polish operations.

The data controller is Banair Inc. Sp. z o.o. ("BANAIR PL", "we", "us"), a company registered in Poland under KRS 0000820834 (NIP 7393935693), with its registered office at Słupy 42, 10-381 Słupy, Poland.

What personal data we collect

We collect personal data only when you contact us through the Site's contact form or by emailing us directly:

Identification and contact data — your name, work email, phone number, organization, country and job title.
Enquiry details — any information you choose to include about your requirement, such as project, location, end user, equipment type, quantities or timing.
Correspondence — the content of the messages, emails and meeting requests you send us.
Technical data — when you visit the Site we automatically collect your IP address, device and browser type, referrer and pages viewed. See the Cookie Policy for detail.

We do not operate marketing sign-ups, gated downloads or online job applications on the Site. We do not knowingly collect special category data and ask that you do not submit it through the Site. Where special category data is genuinely necessary (for example, accessibility needs for a site visit), we collect it directly and tell you why.

How long we keep your data

Enquiries that do not lead to a contract — 24 months from last contact, then deleted or anonymized.
Records linked to a contract — for the life of the relationship, then retained under Polish accounting and archival-law retention periods (the archival category of the documents in which the data are held).
Server and security logs — up to 12 months.
Export-control and sanctions screening records — at least 5 years from the transaction date.

Who we share your data with

BANAIR Group entities in Poland (EU), the UK and, where applicable, our US partner network — to route and handle your enquiry and deliver projects.
Service providers acting as processors under written agreements — principally our web hosting provider and our email provider.
Professional advisers — auditors, lawyers and insurers, where necessary to advise us.
Public authorities, regulators and courts — where required by law, including UODO, the Polish tax authorities, other EU competent authorities, and US BIS / DDTC / OFAC.
Prospective acquirers in the context of a corporate transaction, under appropriate confidentiality protections.

We do not sell personal data, and we do not share personal data for cross-context behavioural advertising.

International transfers

The Site is hosted by cyber_Folks S.A. (ul. Wierzbięcice 1B, 61-569 Poznań, Poland), within the European Economic Area (EEA), so no third-country transfer arises for our core processing.

For any transfer to our US partner network or another country without an adequacy decision, we rely on the EU–US Data Privacy Framework where the recipient is self-certified, otherwise the EU Standard Contractual Clauses (2021/914) plus supplementary measures following a transfer risk assessment. You can request a copy of the safeguards in place by emailing do3tmpuoc@ban-air.com.

Your rights

Subject to applicable law, you have the right to: access the personal data we hold about you and obtain a copy; request correction of inaccurate or incomplete data; request erasure where there is no overriding legal basis to keep it; restrict or object to processing based on legitimate interests; request data portability; and withdraw consent at any time for any processing based on consent (without affecting the lawfulness of processing carried out before withdrawal).

Complaints

International transfers

The Site is hosted by cyber_Folks S.A. (ul. Wierzbięcice 1B, 61-569 Poznań, Poland), within the European Economic Area (EEA). Sharing between the UK and the EEA relies on the UK's adequacy status; transfers from the UK to other countries use the UK International Data Transfer Agreement (IDTA) or the EU Standard Contractual Clauses with the UK Addendum.

For any transfer to our US partner network or another country without an adequacy decision, we rely on the EU–US Data Privacy Framework (and UK Extension) where the recipient is self-certified, otherwise SCCs / IDTA plus supplementary measures following a transfer risk assessment. Your rights

California residents (CCPA / CPRA): in addition, you have the right to know the categories and specific pieces of personal information collected, the right to delete, the right to correct, the right to opt out of any "sale" or "sharing" (we do neither), and the right to non-discrimination for exercising your rights.

To exercise any right, email d0sooc@ban-air.com. We will respond within one month (UK / EU) or 45 days (California). We may need to verify your identity before acting on a request.

Complaints

You can complain to the UK Information Commissioner's Office (ico.org.uk), to the data protection authority in your EU Member State, or, for California residents, to the California Privacy Protection Agency. We'd appreciate the chance to address your concern first — please contact us before escalating.
